Cancellation Policy

1. Introduction and Purpose

This Cancellation Policy outlines the terms and conditions under which services provided by Anker Studios ("we," "us," or "our"), owned by Pienaar Anker and operating from www.ankerstudios.co.za, can be cancelled. This policy applies to users of our niche applications ("Niche Apps"), clients engaging us for custom application development ("Custom Development Projects"), and other services we may offer.

Anker Studios is committed to transparency and fairness. This policy is designed to comply with South African laws, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

This Cancellation Policy should be read in conjunction with our Refund Policy, Pricing Structure, Terms and Conditions, and Privacy Policy.

2. Cancellation by You (The User/Client)

2.1. Niche App Subscriptions

How to Cancel: You may cancel your subscription to any of our Niche Apps at any time. Cancellation can typically be managed through your account settings within the specific app, the platform from which you purchased the subscription (e.g., app store), or by contacting our support team at ankerstudiosza@gmail.com.

Effective Date of Cancellation:

  • Month-to-Month Subscriptions: If you cancel a monthly subscription, the cancellation will take effect at the end of the current billing cycle. You will continue to have access to the Niche App's premium features until this date. No pro-rata refunds will be issued for the remaining period of the current billing cycle (please refer to our Refund Policy).
  • Fixed-Term Subscriptions (e.g., annual): In accordance with the CPA, you may cancel a fixed-term subscription by providing us with at least twenty (20) business days' written notice.

Upon such cancellation, you may be subject to a reasonable cancellation fee. This fee will not exceed a fair amount, taking into account the value of the services provided up to the cancellation date, the duration of the agreement, and the general practice in the industry.

Alternatively, your access will continue until the end of the paid subscription period, and the subscription will not auto-renew.

No Obligation After Cancellation: Once your cancellation is effective and your subscription period has ended, you will no longer be charged, and your access to premium subscription features will cease.

2.2. Niche App In-App Purchases (Credits, Virtual Items, etc.)

Non-Cancellable Once Consumed/Activated: Purchases of digital credits, virtual items, or other one-time in-app purchases are generally final and non-cancellable once they have been used, consumed, or activated.

Unused Credits/Items: If you choose to discontinue using a Niche App or delete your account, any unused credits or virtual items are typically non-refundable and cannot be exchanged for cash or other services, unless otherwise stated in the specific Niche App's terms or our Refund Policy.

2.3. Custom Application Development Projects

Right to Cancel: As a client, you have the right to cancel a Custom Development Project at any stage.

Notice of Cancellation: Cancellations must be communicated to Anker Studios in writing (e.g., via email to ankerstudiosza@gmail.com).

Consequences of Cancellation by Client:

  • Work Completed: Upon cancellation, you will be liable for payment for all work completed up to the date of cancellation. This includes hours worked, resources utilized, and any third-party costs incurred by Anker Studios on your behalf.
  • Cancellation Fee: Depending on the terms of your specific project agreement and the stage of the project, a reasonable cancellation fee may be applicable to cover project disruption and unrecoverable costs. Any such fee will be outlined in your project agreement or Statement of Work. This is in line with the CPA's provisions for advance bookings, orders, or reservations.
  • Handover of Work: Subject to full payment of outstanding fees (including any applicable cancellation fees), Anker Studios will provide you with all completed work and materials developed up to the point of cancellation.
  • Initial Consultations & Discovery Phases: If a project is cancelled during an initial paid consultation or discovery phase, fees for the services rendered during this phase will remain due.

2.4. Donations

Donations made to Anker Studios or in support of specific Niche Apps are voluntary and non-refundable. As such, they are not subject to cancellation once processed.

3. Cancellation by Anker Studios

3.1. Niche App Services

Anker Studios reserves the right to suspend or cancel your access to any Niche App or its services under the following circumstances:

  • Breach of Terms: If you violate our Terms and Conditions, Acceptable Use Policy, or any other relevant policies associated with the Niche App.
  • Non-Payment: For subscription services, if we are unable to process your payment after a reasonable grace period and attempts to notify you.
  • Misconduct: If your use of the Niche App is deemed abusive, fraudulent, illegal, or harmful to Anker Studios, other users, or third parties.
  • Service Discontinuation: We may, at our discretion, decide to discontinue a Niche App or certain features of it. In such cases, we will provide reasonable advance notice where feasible, particularly to paying subscribers, and outline any applicable terms for final access or refunds as per our Refund Policy.

Notice of cancellation by Anker Studios will be provided to you via the email address associated with your account or through in-app notifications.

3.2. Custom Application Development Projects

Anker Studios reserves the right to cancel a Custom Development Project under specific circumstances, including but not limited to:

  • Client Breach: Material breach of the project agreement by the client (e.g., consistent non-payment, failure to provide necessary information/feedback hindering project progress).
  • Unforeseen Circumstances: Events beyond our reasonable control that make project completion impossible or impractical (e.g., force majeure events).
  • Ethical Concerns or Misalignment: If the project scope significantly changes to a point where it conflicts with our business ethics or capabilities.

Consequences of Cancellation by Anker Studios:

  • We will provide written notice explaining the reasons for cancellation.
  • If cancellation is due to client breach, the client will be responsible for payment for all work completed and any applicable costs as outlined in the project agreement.
  • If cancellation is not due to client fault, Anker Studios will work with the client to ensure a fair resolution, which may include a refund for any payments made for uncompleted work, and handover of all work completed to date for which payment has been received. Specific terms will be governed by the project agreement.

4. Process for Requesting Cancellation

Please provide your name, contact details, the name of the Niche App or project, and the reason for cancellation to help us process your request efficiently.

5. Effect of Cancellation

Upon effective cancellation:

  • Access to Services: Your access to the specific cancelled service (e.g., Niche App premium features, ongoing custom development work) will cease as per the terms outlined above.
  • Data: Please refer to our Privacy Policy for information on how your data is handled upon cancellation or termination of services. Some data may be retained for legal or operational purposes.
  • Obligations: Any outstanding payment obligations up to the point of cancellation remain due.

6. Changes to this Cancellation Policy

Anker Studios reserves the right to modify this Cancellation Policy at any time. Any changes will be effective immediately upon posting the updated policy on our website or within our Niche Apps. We will endeavor to notify you of significant changes where feasible. Your continued use of our services after such changes constitutes your acceptance of the new Cancellation Policy.
